Breaches of Fundamental Rights

The phrase ‘fundamental rights’ refers to the ones regarded as inherent to human dignity. It means the specific form taken on by basic human rights within a particular legal system. They are not prerogatives granted to us by the legislative power but rights which the state and the administrations are obliged to respect and to ensure the appropriate conditions for avoiding any obstacle to our access to them as citizens.

In short, they are rights whose importance means that they are protected and safeguarded to the highest degree.

The special consideration these rights demand also means that the legal defence of any possible breaches must follow special judicial proceedings and channels, which are often so complex that they need to be dealt with by experts.
